On January 22, 2025, Thailand will become only the third country in Asia to legally recognize same-sex marriage. The final hurdle was crossed on Tuesday, September 24th, when the Marriage Equality Bill was endorsed by HM the King of Thailand. In 120 days, on January 22, 2025, same-sex couples can legally register their marriages in Thailand.
For same-sex non-Thai couples who want to visit Thailand to get married, there are a few things that remain unknown. Here are some questions that will only be answered once the law comes into effect.
Can same-sex non-Thai couples get married in Thailand?
In theory, the answer is yes. However, Thailand requires each individual to submit an official freedom to marry document issued by that country’s embassy in Thailand (it is known by different names in different countries, but it is official proof that the individual is not currently married and is thus free to marry). Each country has their own requirements for the freedom to marry document. If a country does not legally recognize same-sex marriage, it currently remains unknown whether those citizens would be able to obtain a freedom to marry document from their embassy in Thailand.
Once the law comes into effect we will be able to share more information based on actual cases. For now, we rejoice for Thailand’s LGBTQ+ communities.
